Gambling Commission reopens remote licence application process

The UK Gambling Commission yesterday (Tuesday) evening reopened the application process for companies that wish to qualify for continuation rights regarding a UK remote gambling licence.

The watchdog received applications from 161 companies by the original deadline of midnight on September 16.

However, with the proposed implementation date of the Gambling (Licensing and Advertising) Act 2014 put back by one month to November 1 following a legal challenge to the new legislation, the Commission has now reopened the process.

The Commission told last night that companies will now have up to and including October 23 to apply for continuation rights.

This means that operators who are currently able to provide facilities for gambling in Great Britain... will be able to continue to do so after the Act comes into force and pending determination of their applications provided they either submitted their application, with the relevant application fee, by September 16 or now do so before midnight on October 23,” the Commission said.

The statutory instrument to confirm the new deadline was signed yesterday.

In August, the Gibraltar Betting and Gaming Association filed a legal challenge against the new regulations and the guidance and policies of the UK Gambling Commission.

To give the judge more time to reach a decision on the matter, the UK’s Department of Culture, Media and Sport said last month that it would postpone the date on which the legislation would come into force until November 1, 2014.

In submitting its challenge last month, the Gibraltar Betting and Gaming Association claimed that the new Act is “unlawful, because it is an illegitimate, disproportionate and discriminatory interference with the right to free movement of services... and is irrational”.
